In December 2013, the European Union issued Regulation (EU) 1272/2013, extending the limits of eight polycyclic aromatic hydrocarbons (PAH) from tires to direct and long-term or short-term but frequent contact with human skin under normal and predictable conditions of use Or oral contact with children's toys, children's care products and mass consumer plastics and rubber materials. The expanded scope [1] took effect in December 2015.
In February 2017, we have notified your company [2] that the European Chemicals Agency (ECHA) announced that it is seeking public consultation on the draft guidelines for the use of polycyclic aromatic hydrocarbons in plastics and rubber materials in mass consumer products according to Annex XVII of the EU REACH opinion. The deadline for submitting comments on the draft guideline is April 2017.
On March 7, 2018 [3], ECHA issued guidelines to help the consumer products industry comply with the scope of control of PAHs in Article 50 of Appendix XVII of the REACH Regulation. This (non-legally binding) guide provides a "step-by-step method" to assess whether an item is within the limits, and an incomplete list of items and subcategories within and outside the limits. At the same time, in Annex 3, 13 examples of articles or parts within the limits are listed.
According to the guidelines, polycyclic aromatic hydrocarbons may be present in the following materials:
As a natural pollutant in mineral oil, coal-based filler oil / plasticized oil used in the production of rubber and plastics
Carbon black (soot) intentionally added to elastic rubber to impart characteristics such as color and elasticity
Recycled tires or plastic materials containing the above materials
Paints, varnishes or coatings, such as plastic coatings made of synthetic polymers
The guide specifically incorporates two important considerations, as described below:
The PAH content of the rubber or plastic coating of the article should be evaluated separately
Tiles / mats used in public places and artificial turf used in artificial sports fields are used by the public and are included in the scope of restrictions
Annexes 1 and 3 list items or parts within the limits, and Annex 3 lists illustrative examples. Annex 2 lists examples of consumer products that should be considered out of limits.
